HOW IS A PRINCIPAL EMPLOYER-SUBCONTRACTOR RELATIONSHIP ESTABLISHED?

A principal employer-subcontractor relationship is established when employers who undertake auxiliary tasks related to the production of goods or services, or specific parts of the main work at a workplace, or tasks requiring expertise due to the requirements of the enterprise and the work, employ their workers exclusively at that workplace. Conversely, an employer who undertakes tasks outside the scope of the main and auxiliary work carried out at the workplace—for instance, an employer contracted to perform an additional construction or building repair project at the workplace—cannot be classified as a subcontractor.
