What Is the Temporary Loss of Discernment?
Pursuant to Article 59 of the TCO (Turkish Code of Obligations);
A person who temporarily loses their capacity of discernment is liable to compensate for the damages they cause during this state. However, IF THEY PROVE THAT THEY ARE NOT AT FAULT IN LOSING THEIR CAPACITY OF DISCERNMENT, THEY SHALL BE EXEMPT FROM LIABILITY.
