Divorce Case Due to the Irretrievable Breakdown of the Marital Union
Pursuant to Article 166 of the Turkish Civil Code, each spouse may file for divorce if the marital union has been shaken to its foundation to such an extent that they can no longer be expected to continue their common life. If the fault of the plaintiff is greater, the defendant has the right to object to the filed lawsuit. However, if this objection constitutes an abuse of rights and there is no longer a protectable interest for the defendant and the children in the continuation of the marital union, a divorce may be granted.
