What are Clawback-Subject Acquisitions?
In accordance with Article 565 of the Turkish Civil Code;
- Inter vivos dispositions made by the decedent to a legal heir who has lost their status as an heir as an advancement on their inheritance share, provided that they are not subject to restitution, such as transfers of assets to their descendants or the discharge of debts, or dowries and startup capital given outside the scope of customary practice,
- Dispositions made for the purpose of settling inheritance rights prior to death,
- Donations made by the decedent while reserving the right of free revocation, and donations made within one year prior to their death, excluding customary gifts,
- Dispositions clearly made by the decedent for the purpose of circumventing mandatory portion rules.
