What is the Right of Superficies?
In accordance with Article 726 of the Turkish Civil Code;
The ownership of structures built to remain permanently under or above someone else's land based on a right of construction (superficies) belongs to the holder of the right of construction.
The establishment of condominium ownership or floor easement over independent sections of a building suitable for separate use is subject to the Condominium Law.
A right of construction cannot be additionally established over independent sections.
