Undertaking to Vacate Signed With Blank Dates: Attorney Gizem Gonce in Milliyet

In a statement to Milliyet Uzmanpara, Attorney Gizem Gonce described a dispute over a written undertaking to vacate that was allegedly signed with the date fields left blank. The court of first instance set aside the tenant’s objection to the enforcement proceedings and ordered eviction; the Istanbul Regional Court of Appeal, 35th Civil Chamber, dismissed the tenant’s appeal on the merits.
The decision stated that filling in the dates later does not in itself invalidate the undertaking; a tenant who argues that the document was taken before the property was handed over and that the dates were filled in contrary to the agreement must prove this. In the case at hand, no written evidence supporting that claim was submitted.
