Vicarious Liability
LIABILITY OF THE ANIMAL KEEPER
Pursuant to Article 67 of the TCO;
LIABILITY FOR DAMAGES
A person who permanently or temporarily undertakes the care and management of an animal is liable for the damage caused by the animal.
The animal keeper shall not be held liable if they prove that they exercised the necessary care to prevent the occurrence of such damage.
If the animal was startled by another person or an animal belonging to another person, the animal keeper reserves the right of recourse against these individuals.
Pursuant to Article 67 of the TCO;
