CAN AN EMPLOYER CLAIM COMPENSATION IF A FIXED-TERM EMPLOYMENT CONTRACT IS UNFAIRLY TERMINATED BY THE EMPLOYER?
If an employee fails to start work without a valid reason or quits suddenly, the employer has the right to claim compensation equal to one-fourth of the monthly salary. The employer also has the right to demand compensation for additional damages (TCO Art. 439/1). The employer must exercise this right through a lawsuit or enforcement proceedings within thirty days starting from the date the employee failed to start work or quit. Otherwise, the right to claim compensation shall lapse (TCO Art. 439/3).
