Illegally Obtained Evidence in a Divorce Case
CAN AN AUDIO RECORDING OR IMAGE OBTAINED "WITHOUT THE KNOWLEDGE" OF A SPOUSE BE ACCEPTED AS LEGALLY VALID EVIDENCE IN A DIVORCE CASE? Evidence obtained unlawfully cannot be used as a basis for a verdict. Therefore, a fact determined as a result of the plaintiff spouse placing a LISTENING DEVICE in the home cannot be attributed to the defendant spouse as a fault.
