Decision on the Regime of Separation of Property in Case of Forced Execution
In accordance with Article 209 of the Turkish Civil Code regarding bankruptcy; if the bankruptcy of one of the spouses who has adopted the regime of community of property is decided, the community of property is automatically converted into a regime of separation of property.
In accordance with Article 210 of the Turkish Civil Code regarding attachment; a creditor who has initiated enforcement proceedings against one of the spouses who has adopted the regime of community of property may request the judge to order a separation of property if they suffer a loss during the execution of the attachment.
