What Are the Grounds for Relative Nullity in an Annulment of Marriage Case?
In accordance with Article 148 of the Turkish Civil Code; a spouse who lacks the capacity of discernment due to a temporary reason at the time of marriage may file a lawsuit for the annulment of the marriage. In accordance with Article 149 of the Turkish Civil Code;
1. If a person has consented to the marriage by mistake, despite not wanting to marry at all or not intending to marry the person they married,
2. If a person has married by being mistaken about an important quality in their spouse, the absence of which makes living together unbearable for them,
3. If there has been deception, either spouse may file a lawsuit for the annulment of the marriage.
