What Is the Offense of Intentionally Endangering Public Safety?

Intentionally endangering public safety
Article 170- (1) A person who, in a manner that is dangerous to the life, health, or property of individuals, or in a manner that may create fear, anxiety, or panic among people;
a) Starts a fire,
b) Causes a building collapse, landslide, avalanche, flood, or inundation,
c) Fires a weapon or uses explosive material,
Shall be sentenced to imprisonment for a term of six months to three years.
(2) A person who causes a risk of fire, building collapse, landslide, avalanche, flood, or inundation shall be sentenced to imprisonment for a term of three months to one year or a judicial fine.
The legal value protected by the offense of intentionally endangering public safety is the prevention of comprehensive danger to people and property.
Material elements of the offense of intentionally endangering public safety;
1-Starting a fire
2-Causing a building collapse, landslide, avalanche, flood, or inundation
3-Firing a weapon or using explosive material
The perpetrator of the crime; can be anyone.
The victim of the crime; is the society.
The subject of the crime; is the public safety of the place where the act is committed.
The mental elements of the offense of intentionally endangering public safety; this crime can be committed intentionally.
The investigation procedure of the crime; the investigation of the crime is conducted ex officio; no complaint condition is required.
