WHERE TO FILE AN OBJECTION AGAINST ADMINISTRATIVE FINES?

In accordance with Article 27 of the Misdemeanors Law No. 5326, the authority for appeals against administrative fines imposed by Provincial Directorates of Labor and Employment Agency due to non-compliance with legislation is the Criminal Court of Peace. According to Article 104 of Law No. 5510, the competent administrative courts are the authorities for appeals against administrative fines imposed by Provincial Directorates of the Social Security Institution due to non-compliance with legislation. However, pursuant to Article 5/1-b of the Labor Courts Law No. 7036, the authority for appeals against administrative fines in disputes arising from labor and social security legislation where the Social Security Institution or the Turkish Employment Agency is a party is the labor court.
