WHAT ARE THE LEGAL AND PENAL SANCTIONS FOR DENYING A NURSING BREAK TO A FEMALE EMPLOYEE?
The Labor Law does not provide a penal sanction for denying a nursing break. However, a nursing break is an excused leave derived from the law and is a legal right. As a general rule, it is also subject to payment. While the Court of Cassation rules that no additional payment can be made if a nursing break is not granted, legal doctrine argues to the contrary that payment should be made. We also concur with this view.
