What Are the Protection Criteria?
Within the design registration system, a design is protected only on the condition that it meets the requirements of "NOVELTY" and "INDIVIDUAL CHARACTER".
NOVELTY: Refers to the fact that no identical design has been made available to the public anywhere in the world before the date of application or priority for a "registered design," or before the date on which the design was first made available to the public for an "unregistered design,"
INDIVIDUAL CHARACTER: Refers to the fact that the overall impression a design creates on an informed user differs from the overall impression created on the same user by any design made available to the public before the date of application or priority for a registered design, or before the date on which the design was first made available to the public for an unregistered design.
