Can a Guardian Be Appointed for a Spouse with a Gambling Addiction? Legal Rights When Gambling Addiction Puts the Family in Financial Distress
This article provides general information. Legislation, time limits and amounts may change over time; obtain an up-to-date assessment of your specific situation.
Attorney Gizem Gonce answers: “Gambling alone is not enough; conduct that puts the family’s financial future at risk may be assessed legally.”
Gambling and betting addiction can affect not only a person’s own financial situation but also their spouse, children and family budget. People who say that their spouse gambles continuously, has used up the family’s savings, has incurred debts or has put the family in financial difficulty want to know what they can legally do in this situation.
Under Turkish law, a person may be placed under legal restriction and a guardian appointed for them under certain conditions. However, gambling or betting by itself is not enough for a guardian to be appointed. The conditions set out in Article 406 of the Turkish Civil Code must be met in the specific case.
Attorney Gizem Gonce explained the circumstances in which a guardian may be appointed because of gambling addiction, the legal remedies spouses may pursue and what may be done to protect family assets.
Can a person whose spouse has a gambling addiction ask for a guardian to be appointed for their spouse?
Yes. If the necessary conditions are present, a spouse may ask for the other spouse to be placed under legal restriction and for a guardian to be appointed. The legal basis for this is Article 406 of the Turkish Civil Code.
Under this article, a person may be placed under restriction if, because of prodigality, a dissolute way of life or mismanagement of assets, the person creates a risk of bringing themselves or their family into hardship or poverty, and for that reason becomes in need of constant protection and care, or threatens the safety of others.
What matters here is not merely that the person gambles, but that their conduct produces the consequences required by law. For example, the family budget being spent continuously on gambling, assets being depleted, debts steadily increasing and a risk that the family will be unable to meet its basic needs may be taken into consideration depending on the circumstances of the case.
Accordingly, the spouse may file an application; however, the court decides whether to appoint a guardian.
What conditions must be met for a guardian to be appointed because of gambling addiction?
Each case is assessed in light of its own circumstances. In particular, the following matters are important under Article 406 of the Turkish Civil Code:
The person mismanages their assets or acts prodigally because of gambling or betting,
This conduct creates a risk of bringing the person or their family into financial hardship or poverty,
The condition required by law is present: a need for constant protection and care, or endangerment of the safety of others.
Facts such as how much debt the person has incurred, how they have used the family income, whether they have disposed of real estate or other assets, and how family life has been affected may be important.
Decisions of the Court of Cassation have also emphasized that merely stating that the person has engaged in betting is not sufficient; the conditions required by law must be investigated.
My spouse spends their salary on gambling, takes out loans and incurs debts. What can I do?
First, the financial situation needs to be established with specific evidence. Circumstances such as repeated use of credit, depletion of family savings, attempts to sell real estate or an inability to meet the family’s basic expenses may be important to the legal assessment.
It may be useful in this process to preserve bank records, loan documents, enforcement files, payment documents, records concerning assets and relevant correspondence that were obtained lawfully.
Nevertheless, every debt incurred by a spouse in their own name does not automatically make the other spouse liable. Who incurred the debt, for what purpose and under which legal relationship must be examined separately.
Which legal measures may be available to protect the person’s assets must also be assessed according to the circumstances of the specific case.
Where should an application for the appointment of a guardian be filed?
The court with jurisdiction over guardianship and restriction proceedings is the Civil Court of Peace. The competent guardianship authority is the guardianship office in the place where the person whose restriction is sought resides.
The application should explain the reasons why restriction of the person is sought, set out the events specifically and submit the available evidence.
The court is not required to rely only on the allegations of the spouse who filed the application. Since guardianship proceedings concern public order, the court may investigate whether the statutory conditions are present and ensure that necessary evidence is collected.
In addition, under Article 409 of the Turkish Civil Code, an order restricting a person on grounds of prodigality or mismanagement of assets cannot be made without hearing that person. Accordingly, filing an application does not mean that a guardian will automatically be appointed.
Can a guardian control the bank accounts and assets of a spouse with a gambling addiction?
The appointment of a guardian may have important consequences for protecting the assets of the person under guardianship and representing them in legal transactions. However, this does not mean that the guardian has unlimited authority.
The guardian must act within the law and manage the assets with due care. Some transactions may require permission from the guardianship authority or supervisory authority.
If the court orders restriction and appoints a guardian, the consequences concerning the management of assets and the person’s capacity to enter into legal transactions are determined in accordance with the scope of the order and the applicable statutory provisions.
Separate legal examination is particularly necessary concerning the family home, jointly owned assets, the spouses’ personal property and debts owed to third parties.
Will I also be liable for my spouse’s gambling debts?
The answer depends on the nature of the debt and the legal relationship under which it arose.
Every transaction entered into by one spouse in their own name does not automatically make the other spouse a debtor. However, jointly signed loan agreements, a guarantee, joint liability or other legal undertakings may have different consequences.
In addition, Article 604 of the Turkish Code of Obligations contains a special rule concerning the enforcement and collection through legal proceedings of claims arising from gambling and betting. By contrast, the legal nature of transactions such as a bank loan taken out to gamble must be assessed separately; not every debt can be treated as belonging to the same category.
Therefore, without examining the documents signed by the person, no definitive assessment should be made that the spouse will be liable for none of the debts or will be held liable for all of them.
My spouse does not accept that they have a gambling addiction. Can a guardian still be appointed?
The person’s refusal to accept that they have an addiction does not, by itself, prevent an application from being filed. However, for a restriction order, it must be assessed whether the statutory conditions are met in the specific case.
The court may examine the events and evidence described in the application and carry out any investigation it considers necessary. In an application based on Article 406 of the Turkish Civil Code, the person’s financial conduct and its consequences for the family are particularly important.
The legal purpose here is not to punish a person merely because of their choices, but to protect that person and their family where the statutory conditions are met.
Does appointing a guardian for a spouse with a gambling addiction end the marriage?
No. Appointment of a guardian and divorce are different legal proceedings.
How the gambling habit affects the marital union, the harm it causes to the family’s finances, the state of trust between the spouses and whether the shared life can continue may be assessed separately in divorce proceedings.
Whether grounds for divorce, such as the irretrievable breakdown of the marital union, are present depends on the circumstances of the specific case. A guardianship order does not, by itself, amount to a divorce decree.
A person may consider both applying for guardianship and assessing their rights concerning the marriage. However, the requirements, consequences and procedures for these applications are distinct.
What documents should be prepared for an application to appoint a guardian?
Although the contents of the application vary according to the circumstances of the case, the following documents and records may be considered:
Lawfully obtained records showing gambling and betting expenses,
Loan agreements, debt documents and records concerning enforcement proceedings,
Income and expenditure records showing harm to the family budget,
Available documents concerning the disposal of assets,
Information about people who may have witnessed the relevant events,
Where available, lawfully obtained documents concerning previous applications or treatment processes.
It cannot be said that all of these are required in every application. What matters is being able to explain which specific events support the conditions required by Article 406 of the Turkish Civil Code.
Does appointing a guardian because of gambling addiction definitely protect the family from financial harm?
No. Appointment of a guardian does not erase all debts or automatically protect the person’s assets from every kind of loss.
The purpose of this legal institution is to protect the person where the statutory conditions are met and to manage their legal transactions within the framework of the applicable legislation. Debts incurred in the past, the rights of third parties, the spouses’ property regime and matters relating to the family home must be considered separately.
For this reason, rather than focusing only on an application to appoint a guardian, it is necessary to consider protecting the family budget, determining the legal nature of existing debts and examining any other family-law rights that may apply.
Attorney Gizem Gonce: “A guardian is not appointed for everyone who gambles; the statutory conditions must be assessed on the basis of specific evidence.”
It is important for people whose families are experiencing financial and social hardship because of gambling addiction to know their legal rights. Under certain conditions, the Turkish Civil Code allows a person to be placed under restriction on grounds of prodigality and mismanagement of assets.
However, the most important point in these applications is to establish not merely that gambling has taken place, but that the statutory conditions are met in the specific case. The risk of bringing the family into poverty, the management of assets and the need for protection must be assessed together.
