How Is Unpaid Alimony Collected? Enforcement Proceedings and Disciplinary Imprisonment

Non-payment of alimony awarded by court decision can lead to serious economic problems for alimony creditors. How alimony debts can be collected and what proceedings can be initiated against the debtor are subjects of inquiry. Attorney Gizem Gonce provided significant explanations regarding the collection of alimony claims through enforcement proceedings and statutory application avenues.

What should be done first if alimony is not paid?

When the alimony specified in a court decision is not paid, an enforcement proceeding process may be initiated depending on the content of the decision and the nature of the claim. It is important for the alimony creditor to accurately determine the unpaid amounts and the relevant periods.

During enforcement proceedings, the alimony decision and the claim calculation must be properly submitted to the file. How the enforcement will be conducted is determined according to the nature of the decision and the specific circumstances of the case.

Attorney Gizem Gonce: “Merely waiting is not a solution for an alimony debt”

Attorney Gizem Gonce, stating that alimony creditors must exercise their legal rights in a timely manner, made the following assessment:

“In the event that the alimony determined by a court decision is not paid, the creditor must evaluate legal avenues of application. It is important to accurately identify the unpaid alimony amounts, the months to which they belong, and any partial payments made, if applicable.

Enforcement proceedings may be initiated for the collection of the alimony debt. If statutory requirements are met, disciplinary imprisonment (tazyik hapsi) may also be requested via complaint under Article 344 of the Enforcement and Bankruptcy Law (İİK) regarding a debtor who fails to comply with the alimony decision. However, this sanction is not automatic; the relevant legal prerequisites and procedural requirements must be fulfilled.”

Can imprisonment be applied due to an alimony debt?

Article 344 of the Enforcement and Bankruptcy Law (İİK) regulates that disciplinary imprisonment of up to three months may be imposed upon the complaint of the creditor against a debtor who fails to fulfill the requirements of decisions regarding alimony.

For this avenue to be applicable, the nature of the decision, the status of the enforcement file, the time limitation for complaint, and other statutory requirements must be examined. Disciplinary imprisonment is not a penalty automatically imposed for every unpaid debt.

Gonce said, “Citizens must understand the legal difference between collecting an alimony debt and seeking the application of a sanction against the debtor. In both procedures, it is important to act in accordance with procedural rules and to follow the file carefully.”

Which documents are required if the alimony debtor does not pay?

Depending on the nature of the case, the court decision, documents relating to the enforcement file, payment records, and calculations regarding unpaid months may be important. If payments have been made, demonstrating this with bank records contributes to an accurate assessment of the dispute.

Attorney Gizem Gonce recommended that alimony creditors should not settle solely for verbal statements, but rather preserve documents concerning the payment and enforcement process.

Conclusion: With regard to unpaid alimony, enforcement proceedings and, when statutory conditions are met, complaint procedures may be considered. The method to be pursued must be determined according to the characteristics of the court decision and the enforcement file.
