Reddi miras süresi ve borçlardan sorumluluk — Av. Gizem Gonce

An Heir Who Misses the Deadline for Disclaiming an Inheritance May Face Debts: Why Is the Three-Month Period Important?

Attorney Gizem Gonce explains: An inheritance includes not only assets but also debts.

When a person dies, not only real estate, bank accounts and other assets, but also the deceased’s debts may pass to their heirs. Particularly where loan debts, enforcement proceedings, tax debts and commercial obligations are involved, it is crucial for heirs to know their rights and the statutory deadlines. Heirs who miss the three-month period prescribed for disclaiming an inheritance under the Turkish Civil Code may, depending on the circumstances of the particular case, face the risk of liability for the deceased’s debts with their personal assets.

Attorney Gizem Gonce discussed the matters requiring attention when disclaiming an inheritance, the importance of statutory deadlines and the rights of heirs.

Question: What is a disclaimer of inheritance? Why do heirs take this step?

Attorney Gizem Gonce: A disclaimer of inheritance, known as “reddi miras” under Turkish law, allows a statutory or appointed heir to decline the inheritance passing to them and thereby eliminate the consequences arising from their status as an heir through the procedure prescribed by law. Particularly where the deceased’s debts exceed their assets, disclaiming an inheritance is an important means of protecting heirs’ legal position.

However, a very important detail must be emphasised here: Merely believing that the estate is overindebted is not sufficient. The disclaimer must be made in accordance with the conditions and procedure prescribed by law. Heirs need to monitor the deadlines, investigate the estate’s financial position and assess the legal consequences before taking any action.

Question: When does the three-month period for disclaiming an inheritance begin?

Attorney Gizem Gonce: Under Article 606 of the Turkish Civil Code, an inheritance may be disclaimed within three months. For statutory heirs, this period generally begins when they learn of the death, subject to exceptions in which they can prove that they learned of their status as heirs at a later date. For appointed heirs, the period begins on the date on which the will is officially notified to them.

The point that members of the public should pay particular attention to is that the three-month period cannot automatically be calculated from the date of death in every case. There may be particular circumstances affecting the heir’s status and the date on which they acquired the relevant knowledge. Each case must therefore be assessed in light of its own circumstances.

To avoid missing the deadline, the dates of the death certificate, certificate of inheritance and relevant official notifications should be checked, and the necessary application should be made without delay.

Question: Does an heir lose all their rights if the three-month period is missed?

Attorney Gizem Gonce: As a general rule, an inheritance that is not disclaimed within the statutory period is deemed to have been accepted. In that situation, the heir may face the risk of liability for the deceased’s debts with their own personal assets as well. The matter is therefore not limited to whether the heir has received any property from the inheritance.

However, the expiry of the three-month period does not mean that no legal avenues remain in every case. The Turkish Civil Code contains separate provisions concerning an inheritance being deemed disclaimed by operation of law, known as “mirasın hükmen reddi” under Turkish law. If the deceased’s inability to pay was clearly apparent or officially established at the time of death, the inheritance may be deemed disclaimed where the statutory conditions are met.

For this reason, even where the deadline has passed, the estate’s financial position at the date of death, the nature of the debts, existing enforcement proceedings and other documents should be examined. Without a legal assessment, it cannot be stated that the heir is definitely liable for the debts or bears no liability at all.

Question: Can heirs be deemed to have accepted an inheritance without realising it?

Attorney Gizem Gonce: Yes. Depending on the circumstances of the particular case, conduct that may amount to acceptance of the inheritance can be legally significant. An heir’s appropriation of estate assets as their own, transactions involving estate assets that exceed the limits of ordinary administration and preservation, or acts of disposal incompatible with their status as an heir may affect the right to disclaim the inheritance.

However, not every action automatically means that the inheritance has been accepted. Preservation of the estate, its temporary administration and necessary actions must be distinguished from conduct indicating acceptance of the inheritance.

For this reason, particularly when dealing with an estate burdened with debts, it is important to obtain legal advice before taking actions such as transferring real estate belonging to the estate, using money in bank accounts for personal purposes or disposing of inherited assets.

Question: Can the deceased’s debts be recovered from the heirs’ own assets?

Attorney Gizem Gonce: Under Turkish law, the acquisition of an inheritance also includes the transfer of the deceased’s rights and debts to the heirs. Under Article 599 of the Turkish Civil Code, heirs acquire the inheritance as a whole by operation of law. Under Article 641 of the Code, heirs are jointly and severally liable for the debts of the estate.

As a result of these provisions, liability for the deceased’s debts may not be limited to the assets acquired through inheritance. Recourse to the heirs’ personal assets may also be possible subject to the statutory conditions.

For example, if the deceased had substantial loan debts and the assets left behind are insufficient to cover those debts, serious financial consequences may arise for an heir who does not disclaim the inheritance. However, matters such as the nature of the debt, limitation periods, any security, disclaimer of the inheritance and the conditions for an inheritance to be deemed disclaimed by operation of law must be examined separately.

Question: How can it be determined whether an estate is overindebted?

Attorney Gizem Gonce: First, the deceased’s assets and liabilities must be assessed together. While investigating real estate, vehicles, bank accounts, company shares and other receivables, loan debts, enforcement proceedings, tax debts, surety obligations and commercial obligations must also be taken into account.

Looking only at the apparent assets may be misleading. For example, the existence of real estate registered in the land register does not necessarily mean that the value of the estate exceeds its debts. Mortgages, attachments, co-ownership arrangements and the property’s actual economic value are also important.

My recommendation to heirs is to investigate the financial position as comprehensively as possible and to avoid actions that could amount to acceptance of the inheritance during this process. Particularly where substantial debts or ongoing enforcement proceedings are involved, having the documents examined by a legal professional with relevant expertise may help prevent a loss of rights.

Question: What can be done if the deceased’s overindebtedness is discovered after their death?

Attorney Gizem Gonce: In such a situation, it must first be determined whether the statutory disclaimer period has begun and whether it has expired. The deceased’s financial position at the date of death, the dates on which the debts arose and the date on which the heir learned of the situation should then be investigated.

Article 605, paragraph 2, of the Turkish Civil Code contains a provision under which the inheritance is deemed disclaimed if the deceased’s inability to pay was clearly apparent or officially established at the time of death. In Turkish legal practice, this mechanism is referred to as “hükmen ret”.

However, not every estate burdened with debts is automatically deemed disclaimed by operation of law. Whether the statutory conditions are met in the particular case must be assessed. For this reason, if enforcement proceedings have been initiated against an heir or an order for payment has been served, the notification and the enforcement file must be examined without delay.

Question: Where and how is an application to disclaim an inheritance made?

Attorney Gizem Gonce: Under Article 609 of the Turkish Civil Code, an heir disclaims an inheritance by making an oral or written declaration to the Turkish Civil Court of Peace, known as the “sulh hukuk mahkemesi”. The declaration of disclaimer must be unconditional and unqualified. It is therefore important that the application be made to the correct court, in accordance with the required procedure and within the deadline.

Before applying, the heir’s status, the starting date of the period and any particular circumstances must be established. Especially in cases involving more than one heir, each heir’s legal position and disclaimer period must be assessed separately.

Keeping the documents evidencing the application and monitoring the process through the court records are also important in preventing potential disputes.

Question: What is your most important advice to heirs?

Attorney Gizem Gonce: In inheritance law, a step not taken in time may have serious financial consequences later on. I understand that people who have lost a loved one may not wish to deal with legal details during this sensitive period. However, particularly where an inheritance may involve debts, it is very important not to overlook the three-month period.

My advice to heirs is to investigate the deceased’s financial position, pay attention to official notifications they receive, avoid uninformed acts of disposal involving estate assets and obtain the necessary legal assessment without delay.

It should be remembered that every inheritance case is unique. The three-month period, the conditions for an inheritance to be deemed disclaimed by operation of law and the legal consequences of the heirs’ conduct must be assessed together. Legal assistance obtained at the right time can help people protect their rights and manage potential future disputes more effectively.

Highlighting the importance of deadlines and procedurally proper applications in inheritance law, Attorney Gizem Gonce emphasises that members of the public should not make decisions concerning estates, particularly those that may involve debts, without a legal examination.
