Social Media Law 2026 – Legal Regulations Regarding Social Media

Social media law has become one of the fastest-growing areas of law today. This is because social media is not just a tool for communication; it also stands out as a platform where crimes are committed and spread. For this reason, legal regulations regarding social media are gaining more importance every day.

Despite this, current regulations do not provide sufficient deterrence in many situations. In particular, crimes such as disinformation, fraud, and defamation continue to spread rapidly via social media.

📌 What is Social Media Law?

First of all, social media law is the area of law that regulates content shared in the internet environment and the liabilities arising from these posts. Within this scope, both users and platforms have specific obligations.

Therefore, social media:

  • Provides a space for freedom
  • But also entails legal liability

⚖️ Fundamental Laws Regarding Social Media

In Turkey, social media law is not regulated under a single statute. On the contrary, various laws are applied in conjunction.

🔹 1. Law No. 5651

Law No. 5651 forms the foundation of internet law.

This law:

  • Regulates content removal processes
  • Determines access blocking decisions
  • Imposes obligations on platforms

Furthermore, social media companies must:

  • Maintain a representative in Turkey
  • Respond to court orders
  • Evaluate user applications

Otherwise, they face serious sanctions.

🔹 2. Crimes Within the Scope of the Turkish Penal Code

Additionally, many crimes are committed via social media. These crimes are directly evaluated under the Turkish Penal Code.

The most frequently encountered crimes are:

  • Defamation (TCK 125)
  • Threat (TCK 106)
  • Blackmail (TCK 107)
  • Violation of privacy (TCK 134)
  • Sharing personal data (TCK 136)
  • Fraud (TCK 157)

👉 Moreover, committing these crimes on social media often constitutes an aggravating circumstance.

🔹 3. Social Media Law (7253)

Law No. 7253 imposes additional obligations on social media platforms.

In this context:

  • User applications are reviewed rapidly
  • Content is removed more quickly
  • Fines are imposed on platforms

🔹 4. KVKK (Law No. 6698)

The Personal Data Protection Law directly affects social media posts.

For example:

  • Unauthorized photo sharing
  • Disclosure of phone numbers
  • Publishing private messages

👉 constitutes a crime if there is no explicit consent.

🔹 5. Disinformation Regulation

Finally, the crime of disinformation introduces an important regulation.

👉 Under TCK 217/A:

  • Anyone who spreads misleading information to the public
  • With the intent to disrupt public order

➡️ shall be sentenced to 1 to 3 years in prison.

⚠️ The Biggest Danger on Social Media: Disinformation

Today, false information spreading through social media poses a serious risk. Especially anonymous accounts:

  • Carry out perception operations
  • Manipulate society
  • Influence young people

For this reason, the legal system is attempting to bring this area under control with new regulations.

🧠 Who Holds Legal Liability?

Many people make the following mistake:

👉 "I only shared it, I am not responsible."

However, this line of thinking is incorrect. Because:

  • The person who creates the post bears liability
  • The person who retweets also assumes liability
  • The person who comments is also separately liable

👉 In other words, everyone is responsible for their own actions.

🚨 What Happens If You Commit a Crime on Social Media?

If a person commits a crime via social media:

  • A criminal case is filed
  • Compensation is demanded
  • Content is removed

Moreover, using a fake account does not eliminate liability.

🔍 What Do New Regulations Target?

The latest regulations aim to build a stronger system. In this context:

  • Platform oversight is increased
  • Content removal is accelerated
  • Heavier sanctions for crimes are introduced

👉 The goal is to make social media safer.
