WHAT IS THE STATUTE OF LIMITATIONS FOR WAGES AND COMPENSATION?
With Additional Article 3 added to the Labor Law No. 4857, a 5-year statute of limitations has been introduced for claims arising from employment contracts regarding:
a) Annual Leave Pay
b) Severance Pay
c) Compensation arising from the termination of the employment contract without complying with the notice requirement,
d) Bad Faith Compensation,
e) Compensation arising from the termination of the employment contract without complying with the principle of equal treatment.
The new statute of limitations will apply to annual leave pay and compensation arising from employment contracts that ended after 25.10.2017, the date the Law entered into force.
