What can be done if the employer did not report the days worked to the Social Security Institution (SGK)?
If the conditions exist, the employee can request the determination of the periods actually worked by filing a lawsuit for the establishment of social insurance periods (hizmet tespiti davası).
Is there a time limit in a lawsuit for the establishment of social insurance periods?
Article 86/9 of Law No. 5510 generally provides a five-year time limit, calculated from the end of the year in which the work was performed, for establishing periods not reported to or identified by the Social Security Institution. The period of employment, the applicable provisions and exceptions must be assessed separately.
For general informational purposes. The documents, application routes, and deadlines of the specific case must be evaluated separately.
