If there are no descendants: parents and siblings

Count living siblings only. Siblings take only the share of a parent who has died.

Assumptions

  • No heir has disclaimed the inheritance, been disinherited or waived it by contract.
  • Adopted children and children born outside marriage with established parentage take the same share as other children (arts. 498, 500).
  • Children of predeceased grandchildren, children of predeceased siblings and the split within the grandparents’ line are not calculated.
  • The spouse’s claim under the matrimonial property regime is settled before the estate is divided; this tool does not calculate it.
