Ten questions about rights, procedures and common legal issues in Türkiye.
This guide concerns Turkish law and provides general information. The appropriate procedure and time limits depend on the circumstances.
1. How can Turkish citizenship be acquired?
Turkish citizenship may be acquired by birth or through the routes provided by law. General naturalisation, marriage, exceptional acquisition and reacquisition each have different requirements.
2. Does marrying a Turkish citizen automatically grant citizenship?
No. Marriage alone does not automatically confer citizenship. The applicable period, family unity, the genuine nature of the marriage and the other conditions under the Turkish Citizenship Law must be assessed.
3. How can a residence permit be obtained in Türkiye?
The requirements and documents depend on the type of residence permit. Applications are made under the applicable legislation and the current procedures of the Presidency of Migration Management.
4. What can be done against a deportation decision?
The type of decision, its notification date and the available legal remedy must be examined. Time limits for an annulment action and any application to suspend enforcement are particularly important.
5. What are the consequences of working in Türkiye without a work permit?
The applicable legislation may provide administrative sanctions for both the foreign worker and the employer. The circumstances, type of work and any applicable exemptions must be assessed.
6. Can a foreign national buy property in Türkiye?
Acquisition of real estate by foreign individuals depends on nationality, the location of the property, area limits and specific statutory restrictions.
7. In which country can an international divorce case be brought?
Jurisdiction and the applicable law depend on the spouses’ residence and nationality, the nature of the claim and the relevant rules of private international law.
8. Is a foreign divorce decision valid in Türkiye?
Depending on the decision, recognition or enforcement proceedings may be required for a foreign judgment to be entered in Turkish civil registers or to produce legal effects. Administrative registration may also be available for certain decisions.
9. Do the family members of a person acquiring Turkish citizenship also become citizens?
Their position depends on the route by which citizenship is acquired and the specific conditions of the Turkish Citizenship Law. Citizenship does not automatically extend to every family member.
10. What can be done if a citizenship application is rejected?
The reasons for rejection and the notification date should be examined. An annulment action before the administrative courts or another appropriate remedy may be considered under the applicable legislation.
